1. About these terms
These Terms & Conditions ("Terms") form a legal agreement between you and Hypnotrack™. By using our website at hypnotrack.com, creating an account or purchasing any Hypnotrack service, you agree to these Terms.
Please read them. We've kept the language plain and the document as short as honestly possible. If anything's unclear, email us at hello@hypnotrack.com and we'll explain.
These Terms should be read alongside our Privacy Policy, which explains how we handle your information.
2. Who we are

In these Terms, "we", "us" and "our" mean Hypnotrack™. "You" and "your" mean you, the customer.
3. What Hypnotrack is
Hypnotrack provides personalised audio hypnotherapy sessions. Each session is built from your answers to our intake questions, your voice recordings and other details you choose to share. The script is written by an AI model, voiced using AI-generated speech and delivered to you as an audio file.
Hypnotrack is built on the practice of Kris Byers, a qualified hypnotherapist and operated through Hypnotrack™, where Orla Byers serves as a director. The therapeutic frameworks behind our sessions draw from established practices including hypnotherapy, cognitive behavioural therapy (CBT) and neurolinguistic programming (NLP).
4. What Hypnotrack isn't
Hypnotrack is a complementary wellness tool. It is not and is not intended to be, a substitute for:
- Medical advice, diagnosis or treatment
- Psychiatric or psychological treatment
- Counselling or therapy from a qualified mental health professional
- Crisis intervention or emergency services
- Treatment for any specific disease, condition or disorder
Hypnotrack does not diagnose, treat, cure or prevent any disease, illness or condition. We make no claims that any specific outcome will result from using our service.
If you have or think you may have, a medical or psychiatric condition, please speak to your doctor or qualified mental health professional. We provide a safeguarding screen at intake to help identify when Hypnotrack isn't suitable for someone — but you remain responsible for seeking appropriate professional support where needed.

5. Eligibility
To use Hypnotrack you must:
- Be at least 18 years old
- Have the legal capacity to enter into this agreement
- Not have any of the conditions identified in our safeguarding screen as making Hypnotrack unsuitable for you (including but not limited to diagnosed psychosis, schizophrenia, dissociative disorders, severe untreated PTSD, active suicidal ideation or severe substance dependency)
By using Hypnotrack, you confirm that all of the above applies to you. If something changes — for example, you receive a new diagnosis — we ask you to stop using Hypnotrack and consider whether professional support is more appropriate for your situation.
6. Your account
You'll typically access Hypnotrack via a secure magic-link login (a one-time link emailed to you). You don't set a password.
You're responsible for:
- Keeping your email account secure (since access to it gives access to your Hypnotrack portal)
- Making sure the information you give us is accurate
- Telling us promptly if you suspect unauthorised access
You may not share access to your account or your Hypnotrack sessions, with anyone else.
7. Orders & pricing
Our current prices and what's included are set out on our Pricing page. All prices are shown in pounds sterling (GBP) and include VAT where applicable.
When you complete an order, you're entering into a contract with us for the specific service you've selected. The contract forms when we confirm your order (the moment your payment is successful and you receive an order confirmation).
We reserve the right to refuse orders, particularly where:
- Our safeguarding screen indicates Hypnotrack isn't suitable
- We suspect fraud, abuse or misuse
- The information given appears to be incorrect or designed to manipulate the system
If we refuse your order, we'll refund any payment in full.
8. Payment
Payments are processed by Stripe. We do not see or store your card details. By making a payment, you also agree to Stripe's terms.
You authorise us (through Stripe) to charge your chosen payment method for the amount of your order at the time of checkout. We may also charge for any subscriptions you separately agree to (see below).
9. Delivery
Once your payment is confirmed, we begin generating your personalised session. Delivery is by email, with a link to your Hypnotrack portal where you can listen and re-download your audio.
Most sessions are delivered within 30 minutes of payment but in unusual circumstances delivery may take longer. If your session hasn't arrived within 24 hours, please email us so we can check what's happened.
If something goes wrong on our side and we're unable to deliver your session, we'll either complete the delivery as soon as we reasonably can or refund your payment in full at your option.
10. Refunds & cancellation
10.1 Our 14-day promise
We want you to feel good about your purchase. If for any reason you're not happy with your Hypnotrack session, you can request a full refund within 14 days of purchase — no questions asked. Just email hello@hypnotrack.com and tell us you'd like a refund.
This goes beyond your statutory rights under UK consumer law and applies even if you've already downloaded and listened to your session.
10.2 Statutory cooling-off
Under UK consumer law, you also have specific statutory rights regarding digital content. By proceeding to receive your personalised session, you expressly acknowledge that:
- You consent to immediate performance of the contract (so we can begin generating your session straight away)
- You understand that this affects your statutory cooling-off rights for digital content
However — and this is important — our 14-day promise above is more generous than the statutory minimum and it applies regardless. You can ask for your money back within 14 days, even after using your session.
10.3 Subscriptions and rollovers
If you purchase a programme that includes a rolling monthly subscription (for example, our 90-day or annual programmes that roll into a £29 monthly plan), we will:
- Make the rollover terms clear at checkout, before you pay
- Send you a reminder before the first rollover charge
- Allow you to cancel any subscription at any time, by managing it in your portal or emailing us
Cancellations take effect at the end of the current billing cycle. You'll continue to have access to the subscription benefits until the end of the cycle you've already paid for but you won't be charged again. We don't pro-rate refunds for partial months unless required by law.
10.4 How refunds are processed
Approved refunds are sent back to your original payment method. They typically arrive within 5–10 working days, depending on your bank.
11. Ownership & your licence
The audio session we deliver to you contains AI-generated content, voice synthesis, music and frequencies — all of which we own or have the right to use.
When you purchase a Hypnotrack session, we grant you a personal, non-transferable, non-exclusive licence to:
- Listen to your session as often as you want
- Download a copy for your own use
- Use it for your personal wellness, on your own devices
You may not:
- Share, redistribute, sell, gift or upload the audio anywhere public (social media, file-sharing sites, podcasts, etc.)
- Use it commercially or for any business purpose
- Modify, sample or remix it
- Claim it as your own work
- Reverse-engineer, copy or replicate the techniques used to generate it
We retain all intellectual property rights in the Hypnotrack platform, the underlying scripts, the voice models, the music, the brand and anything else you'd reasonably consider ours.
The personal information you give us (your voice recordings, answers and other inputs) remains yours. By submitting it, you grant us the rights described in our Privacy Policy — essentially, a licence to use that information solely to deliver the service to you.
12. Acceptable use
You agree to use Hypnotrack honestly and in good faith. You will not:
- Submit false, misleading or fabricated information
- Use the service in a way that could harm yourself or others
- Submit content that is unlawful, abusive, harassing or infringing on third-party rights
- Attempt to manipulate the AI through prompt injection or similar techniques
- Try to access other users' data or sessions
- Resell, share or redistribute Hypnotrack sessions
- Reverse-engineer the platform, copy our methods or use Hypnotrack content to train competing AI systems
- Use Hypnotrack while operating heavy machinery, driving or doing anything else where focused attention is required
If you misuse Hypnotrack, we may suspend or terminate your access without refund.
13. Third-party services
Hypnotrack relies on a small number of trusted third-party services to operate (including Stripe for payments, AWS for hosting, Anthropic, ElevenLabs, Hume AI, SendGrid and Vercel). Where these third parties have their own terms or service interruptions, those may affect your experience of Hypnotrack.
We've chosen each third party carefully and require them to handle your data appropriately. We can't, however, accept responsibility for outages, errors or changes to their services that are outside our reasonable control.
14. Disclaimer of medical claims
Although Hypnotrack is shaped by the training and practice of a qualified hypnotherapist, the service itself is delivered as audio created by AI. Hypnotrack does not provide medical, psychological, psychiatric or therapeutic services in the regulated sense.
We make no specific claims about outcomes. Results vary widely and what works for one person may not work for another. Hypnotrack is best understood as a tool that some people find calming, helpful or supportive, alongside whatever else they're already doing.
You are responsible for deciding whether Hypnotrack is right for you. If in doubt, please speak to your GP, mental health professional or a qualified hypnotherapist.
15. Our liability
15.1 Things we don't exclude or limit
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This means we're always responsible for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Breach of your statutory rights as a consumer
- Any other liability that can't be limited under English law
15.2 Things we do limit
Subject to section 15.1 above, our total liability to you arising from or connected with Hypnotrack is limited to one thousand pounds (£1,000) per claim or the total amount you've paid us in the 12 months preceding the claim — whichever is greater.
We are not liable for:
- Loss of profits, business opportunities or anticipated savings
- Indirect or consequential losses
- Outcomes that do or don't happen as a result of using a Hypnotrack session
- Decisions you make or fail to make based on the content of a session
15.3 Why this matters
Hypnotrack is a wellness tool sold for a relatively modest price. The cap above keeps the service available and affordable. We carry professional indemnity insurance through Balens, which sits behind these limits where applicable.
16. Changes to the service
We're a young business and Hypnotrack will evolve. We may:
- Add new features, pathways or services
- Change or remove existing features
- Adjust prices for new orders (existing orders are honoured at the price you paid)
- Take the service offline temporarily for maintenance or updates
We'll do our best to give reasonable notice for significant changes that affect existing customers.
17. Changes to these terms
We may update these Terms from time to time. The "last updated" date at the top of this page tells you when. For any change that materially affects your rights or how the service works for you, we'll let registered customers know by email and give you a fair opportunity to review.
If you continue using Hypnotrack after a change takes effect, that means you accept the updated Terms. If you don't accept them, you can request a refund (within 14 days of purchase) and stop using the service.
18. Termination
You can stop using Hypnotrack at any time. If you'd like your account fully closed and your data deleted, just email us.
We may suspend or terminate your access if:
- You materially breach these Terms (including the acceptable use rules)
- We're required to do so by law
- We reasonably believe doing so is necessary to protect ourselves, our customers or third parties
If we terminate for serious breach, we may withhold refunds for sessions affected by the breach. Where termination is at our initiative for reasons unrelated to your conduct, we'll refund any unused portion of paid services.
19. Disputes & governing law
19.1 Talk to us first
If you have a complaint, please email hello@hypnotrack.com first. We genuinely want to hear from you and most things can be resolved with a calm conversation. We aim to respond within 5 working days.
19.2 Governing law
These Terms and any non-contractual obligations arising from them are governed by the laws of England and Wales.
19.3 Jurisdiction
The courts of England and Wales have non-exclusive jurisdiction to settle any disputes that cannot be resolved through direct contact. If you live in another part of the United Kingdom, you may also be able to bring proceedings in your home jurisdiction. If you live outside the UK, you may have rights under your local consumer protection laws — these Terms don't take those rights away.
19.4 If you're an EU consumer
If you're a consumer based in the European Union, you can also use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
